End User License Agreement

By downloading or using the KinderKindle application, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.
1. Scope of License
KinderKindle grants you a personal, non-exclusive, non-transferable, limited license to install and use the application on any compatible device that you own or control. This license is for educational and entertainment purposes only and is intended for use by children under adult supervision.
You may not copy, modify, or attempt to extract the source code of the app. You also are not allowed to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to KinderKindle.
2. Consent to Use of Data
You agree that KinderKindle may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the Licensed Application.
KinderKindle is committed to child safety and data privacy. We do not sell data to third parties. For more information, please refer to our separate Privacy Policy which details how we handle information from our young learners.
Special Notice for Educators
If you are using KinderKindle in a classroom setting, you represent that you have the authority to bind your educational institution to these terms and have obtained necessary parental consents required by local law.
3. Termination
The license is effective until terminated by you or KinderKindle. Your rights under this license will terminate automatically without notice from KinderKindle if you fail to comply with any term(s) of this license. Upon termination of the license, you shall cease all use of the Licensed Application and destroy all copies, full or partial, of the Licensed Application.
4. Services & Third Parties
The Licensed Application may enable access to KinderKindle's and/or third-party services and websites. Use of these Services requires Internet access and use of certain Services requires you to accept additional terms. KinderKindle reserves the right to change, suspend, remove, or disable access to any Services at any time without notice.
5. No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
6. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL KINDERKINDLE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION.
